2. If we are not able to collect your personal information, we may not be able to provide our services to you should you choose not to give us your information.

3. Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information or opinion is true or not and whether the information or opinion is recorded in a material form or not.

The types of personal information we collect includes:

(a) names, job titles, contact and address details;

(b) information in identification documents (for example, passport and driver’s licence);

(c) tax file numbers and other government-issued identification numbers;

(d) date of birth and gender;

(f) details of superannuation and insurance arrangements;

(g) educational qualifications, employment history and salary; and

(h) personal information about your spouse and dependents.

4. We will not collect sensitive information about you.

5. Generally, we collect your personal information from you directly. For example, when we deal with you in person or over the telephone, when you send us correspondence (including via email), when you complete a questionnaire, form or survey, when you subscribe to our publications or when you submit personal information through our website.

6. Sometimes we may collect your personal information from a third party. For example, we may collect your personal information from your employer, your personal representative or a publicly available record. We may also be required by Australian laws (such as the National Consumer Credit Protection Act 2009 (Cth)) to collect your personal information.

7. If you provide us with someone else’s personal information, you should only do so if you have their authority or consent to provide us with their personal information. You should also take reasonable steps to inform them of the matters set out in this Privacy Policy or any Privacy Collection Statement we give you.

8. CC holds personal information in hard copy and electronic formats. We take security measures to protect the personal information we hold, including physical security measures (for example, security passes to enter our offices and storage of files in lockable cabinets) and technological security measures (for example, restriction of access, firewalls, the use of encryption, passwords and digital certificates). We also have document retention policies and processes.

9. In addition to the other purposes set out in this Privacy Policy, CC manages your personal information for a number of purposes including:

(a) to verify your identity or to conduct appropriate checks for credit-worthiness and for fraud checking;

(b) to provide professional services;

(c) to respond to requests or queries;

10. The types of third parties (including overseas third parties) to whom we may disclose and/or sell your personal information include:

(d) any third parties (including those mentioned in this clause 12) for the purpose of allowing them to send marketing material to you.

11. If you do not provide us with the personal information we have requested, we may not be able to complete or fulfil the purpose for which such information was collected, including providing you with the services we were engaged to perform.

12. CC may disclose information about you to a credit reporting agency for the purpose of obtaining a consumer credit report about you.

13. You give CC your consent to obtain a credit report (which includes consumer credit information about you) from a credit reporting agency and allow the credit reporting agency to create or maintain a credit information file containing information about you.

14. We may verify your identity using information held by a credit reporting agency. To do this we may disclose personal information such as your name, date of birth, and address to the credit reporting agency to obtain an assessment of whether that personal information matches information held by them. They may give us a report on that assessment and in doing so may use personal information about you and other individuals in their files.

15. CC may disclose your personal information to overseas recipients, including recipients in the United States of America to allow them to send marketing material and/or to offer to provide goods and services to you. We may also backup and store data to cloud-based services which are potentially hosted outside of Australia. These servers are commonly located in the United States of America, Singapore, The Netherlands and Ireland.

16. If you consent to the disclosure of your personal information by agreeing and consenting to the terms of this Privacy Policy, subclause 8.1 of the APPs will not apply to the disclosure. Subclause 8.1 requires that an overseas entity to whom disclosure of your personal information is made take such steps as are reasonable in the circumstances to ensure that the overseas recipient does not breach the APPs (other than APP 1) in relation to your personal information.

17. CC may also use your personal information for the purpose of marketing its services. If you do not want to receive marketing material from us, you can either use the unsubscribe feature in an email or email requesting to no longer receive marketing material from us.

26. These Special Privacy Provisions form part of this Privacy Policy. To the extent of any inconsistency between the above provisions and these Special Privacy Provisions, the Special Privacy Provisions prevail.

27. In addition, by providing your personal information to CC, we may offer your information to potential providers of loan facilities and finance brokers and lead providers. To that end, by agreeing or consenting to the provisions of this Privacy Policy, you consent to:

(a) CC providing your personal information to third party credit providers and finance brokers who may provide you with offers or information on goods or services they may be able to provide to you; and
